CrossFit Palmerston Membership Agreement

Agreement made on the 04/27/2024, between CrossFit Palmerston. referred to herein as the CrossFit Palmerston(CrossFit Palmerston), and

Both parties agree as follows:

1. Membership Fees
All fees and schedules are subject to change without notice. There are no refunds for direct debit membership fees, upfront membership fees, program fees, visit passes or casual visits. The member's credit card or bank account will be charged according to the membership option.

  • Casual Session, Renew date: 04/27/2024
All direct debit membership rates are paid fortnightly or monthly.
Face to face personal training or nutrition coaching can be charged on a reoccurring debit or session by session.
 
2. Freeze Policy
Direct Debit Members may put their membership on freeze, no less than 1 week for up to 8 week's free of charge per calendar year. Notice of freeze must be given to CrossFit Palmerston by email only and will be processed within 2 business days once received. Members will not be billed during the freeze period and billing will resume automatically upon end of freeze. The current membership agreement will be extended by the number of months frozen. If a cancellation request is received during the freeze period then the membership will be reactivated and the 30 days notice period will begin from that date. No freezes on upfront memberships, online memberships, programs and visit passes. 

3. Late Payment / Declined Payment Fees
A $15 dishonour fee will be charged on any declined payments as well as any declined fees charge by IntegraPay (direct debit company). Until overdue fees are paid, members not entitled to attend classes. Any declined payments for retail items paid at the gym will incur a $5 dishonour fee.

4. Cancellation of Membership by Member
You may cancel at any stage on a direct debit membership however we do require 30 days written notice via email to crossfit.palmerston@gmail.com. Any scheduled payments within this 30-day period will be processed as scheduled. SMS, social media or verbal discussions to cancel will be directed to email the request and will be processed once received within 2 business days. If your membership is on freeze and a cancellation is requested, the membership will then be reactivated and 30 days notice from that point of written notice. If you choose to reactivate your membership after it is cancelled, membership rates in effect at the time of reactivation will be applicable (membership rates are subject to change). If you are on an online program then the 30 days notice does not apply, simply send us email and will be cancel within 2 business day. 
*the above is not applicable to upfront or visit pass holders as your expiration date is in line with the fixed term membership or pass you have purchased*

5. Personal Training, Nutrition Coaching, Online Training & Programs
Any programs purchased are non refundable. This includes but not limited to personal training, online programming, nutrition coaching, CrossFit Kids, group training, yoga, strength and weightlifting programs, any and all challenges. Face to face personal training and nutrition coaching sessions will incur full fee for any cancellations within 24 hours. Online programs and coaching requires 2 weeks notice to cancel. No freezes are permitted on online coaching. 

6. Attire
Appropriate footwear is highly recommended and required to train as a member of CrossFit Palmerston. Any barefoot lifting or running must be approved by the coach of the particular class and the management, and will be evaluated on a strict case by case basis. CrossFit Palmerston is not liable for any harm or injury due to deviations in the recommended standards of footwear.

7. Lost Articles
CrossFit Palmerston assumes no responsibility for lost or stolen articles. Lost and found articles not claimed will be donated to charity.

8. Smoking, Food and Drink.
No smoking is allowed in any part of the facility. Drinks may be taken into workout areas if it is in a non-breakable, enclosed container. Food is only to be consumed in the front waiting area or red matted area. It is the responsibility of the member to ensure rubbish is put in the allocated bins and food scraps are cleaned up.

9. Children
Members must be 13 years of age or older unless supervised by a parent or legal guardian at all times. Guest/Visitors under the age of 13 must be supervised by a parent or legal guardian at all times. The kids corner within the gym is the allocated area for children to stay and ensure no interruption to the classes. Parents that bring along their children are responsible to clean up any mess or food prior to leaving the gym. Those children participating in CrossFit Kids program or similar are able to be left onsite and will be supervised by the coach on duty.

10. Conduct
CrossFit Palmerston is committed to the health, safety, welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. CrossFit Palmerston has the right to judge behavior and respond accordingly. This right includes, but is not limited to, termination of membership of any member engaging in unacceptable behavior.

11. Damages
Members shall pay for any damages to CrossFit Palmerston property which results from the willful or negligent conduct of member, member's guest or dependent children.

12. Rules and/or Regulations
Members who do not observe CrossFit Palmerston rules and regulations or who abuse equipment in any fashion will be asked to leave. The management reserves the right to terminate membership to anyone who refuses to observe any of CrossFit Palmerston's rules or regulations. Not all rules and regulations are listed in this agreement. CrossFit Palmerston reserves the rights to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by CrossFit Palmerston

13. Use of Photo and Video
CrossFit Palmerston, its representatives and employees have the right to take photographs of Member and Member's property whilst training with CrossFit Palmerston.

CrossFit Palmerston is authorized to use and publish these photos or videos in print and/or electronically. CrossFit Palmerston may use such photographs of Member with or without Member's name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

14. Miscellaneous
a. This Agreement contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon prior written consent of all parties. This agreement shall be governed by the laws of the State of NT without regard to the principles of conflict of laws thereof and treated as a contract entirely made and execute within NT

b. Member has read, and fully agrees to the term of this Agreement and understands and agrees that by signing this Agreement (which contains a waiver, release and assumption of risks) Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement. 

c. CrossFit Palmerston reserves the right to increase membership (including programs) rates and terms & conditions at any stage without warning. CrossFit Palmerston reserve the right to refuse any person a casual visit, visit pass or membership without reason however will not discriminate against race, age, sex or cultural background.
