CrossFit Hillcrest Membership Agreement

Agreement made on 03/18/2024 between CrossFit Hillcrest (referred to herein as "CrossFit Hillcrest") and:

(referred to herein as "Member"). Both parties agree as follows:

1. Membership Fees

Membership fees and class schedules are subject to change without notice; however, CrossFit Hillcrest will make every effort to promulgate these changes in advance. There are no refunds for membership fees. The member's credit card / bank account will be charged on the first of every month.

Membership Option: 1 Class

2. Three-Day Right of Rescission

New members have three days after signing this Agreement to cancel their membership without penalty. If the Agreement is cancelled within three days, CrossFit Hillcrest will return all amounts paid (in the same manner paid) within 30 days after cancellation, provided no services have been rendered. If original payment was by credit card, the amount paid will be credited to the card used for the original transaction. To cancel, new members must call, email, or come into CrossFit Hillcrest and inform CrossFit Hillcrest of their wishes to cancel.

3. Membership Suspension Policy

Members may suspend their membership payments for up to three months. Notice of suspension must be given to CrossFit Hillcrest over the telephone or by email prior to the first day of the month suspension is requested to begin. Billing will resume automatically upon end of suspension. Military members can suspend their accounts for sufficient length of time to cover workups and deployment.  CrossFit Hillcrest will not prorate a suspended membership.

4. Renewals and Cancellations of Membership by Member

Monthly Memberships: Will automatically renew the first of every month. Member must inform CrossFit Hillcrest prior to the first of the month if they wish to cancel.

Intro Memberships: CrossFit Hillcrest will reach out via email to members at the end of any Intro Membership listing options, and the action that CrossFit Hillcrest will take. If the member wishes for different action to be taken, they must contact CrossFit Hillcrest and let them know.

There are no refunds for membership fees, and CrossFit Hillcrest will not prorate a cancelled membership.

5. Lost Articles

CrossFit Hillcrest assumes no responsibility for lost or stolen articles. Lost and found articles not claimed within 30 days will be donated to charity or discarded.

6. Club Rules and Policies.

A. Technique. Consistency. Intensity. In that order.
B. RESPECT EVERYONE HERE. We promise to respect your time, your needs, your goals, your desires and your limitations. We ask that you do the same for your fellow athletes, and that you do the same for us. If you can’t handle diversity, you’re not welcome to work out with us.
C. Group classes take priority over open gym. There’s enough room here for everyone to get a good workout if they work together – please communicate, and don’t forget Rule B.
D. No plyo boxes under the pull-up bars. If you need a step up, you can put a plyo box to the side.
E. Try to control the weight, especially during a bail. Do not let it bounce and interfere with other athletes.
F. Do not drop barbells from shoulder height or higher if you only have 10# rubber bumper plates on them. Please us the solid plastic 10# bumper plates (this will help prevent the core from ripping out of the bumper plates).
G. Do not walk through someone’s “lifting space”. Use the fake grass area to move back and forth when someone is attempting a lift.
H. This is YOUR facility. Don’t abuse the equipment. Clean up your sweat angels. Put things back where they belong when you’re done using them.  Put the lid down. Chalk your hands in the bowl. Don’t break the bowl. Don’t put the bowl in front of a fan. Basically, be nice to the chalk bowl.
I. Don’t leave your gear in the gym overnight. It will go to lost and found, and thence to Goodwill. We are not responsible for your stuff.
J. Please RSVP via WODHOPPER. We reserve the right to cancel a class if no one has RSVP’d at least two hours prior (ten hours prior for early morning classes). Class size caps are listed in WODHOPPER.
K. No Shows. If you RSVP for a class and then don't show up, we reserve the right to charge you a $10 No Show fee. In general, this will only happen if there are members waitlisted for that class.
L. The gym will be open NLT 10 minutes prior to the start of class. Classes start at the scheduled time with an instructor led group warm-up.
M. If you see someone you don’t recognize standing around looking lost, please take the time to welcome them to the Club.
N. Do not try to open a roll up door unless you make sure it is unlocked on BOTH SIDES.
O. Dogs and children cannot be a distraction to our athletes in any way. Two strike policy. Dogs must be kept outside on the patio or within 6 feet of the roll-up doors.
P. No bike parking in the Club. Use the bike racks outside. If your bike must be kept in the shade, you can park it on the side of the patio. 

7. Use of Photo and Video

CrossFit Hillcrest, its representatives and employees have the right to take photographs of Member and Member's property whilst training with CrossFit Hillcrest. CrossFit Hillcrest is authorized to use and publish these photos or videos in print and/or electronically. CrossFit Hillcrest may use such photographs of Member with or without Member's name and for any lawful purpose, including such purposes as publicity, illustration, advertising, and web content.

8. Miscellaneous

a. This Agreement contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon prior written consent of all parties. This agreement shall be governed by the laws of the State of California without regard to the principles of conflict of laws thereof and treated as a contract entirely made and execute within California.

b. Member has read and fully agrees to the term of this Agreement and understands and agrees that by signing this Agreement (which contains a waiver, release and assumption of risks) Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement.
