CrossFit G6 Membership Agreement

Both parties agree as follows:
1. Membership Fees:
All membership options are using autopay with a credit card only. All fees and payment schedules are subject to change with 28 days notice. There are no refunds for membership fees. The member's credit card will be charged according to the membership you selected. All payments are made in advance. Weekly & Bi-Weekly Payments are charged on the same day each week or every other week which pays for the upcoming week/two weeks. You are signing up for a minimum of 4 weeks. iIf you chose a PIA (pay in advance) membership option then you have signed up for a minimum of the amount of weeks that you paid in advance for. All memberships automatically renew and continue to charge unless you cancel which requires a 28 day notice (more information on cancellations is down below). We reserve the right to increase your membership pricing once per year by up to 3% (with at least a 28 day notice). This is simply to help cover the inflation costs of rent, equipment, supplies, etc.

2. Freeze Policy:
Members may freeze their account with 7 days notice for up to 3 months for a freeze fee of $50. This freeze fee will be credited back to your membership as long as you come back within 3 months. If you go beyond 3 months before you come back you will not be credited the freeze fee and you will have to abide by the membership options that are current at that time.

3. Late Payment / Declined Credit Card Fees:
A late payment/declined credit card fee of $10 will be charged on any payment past due for more than 7 days. The $10 fee will be charged every time you go past due more than 7 days. So if you get 14 days behind then the charge will be $20, 21 days = $30, etc. Membership fees must be paid on their due date (or within the 7 day grace period). Please contact us for payment arrangements if payments are declined.
4. Cancellation of Membership by Member:
A member may cancel their membership at anytime with 28 days notice unless you did a PIA (Pay In Advance) Option. There are no refunds for pay in advance memberships. Members may cancel their membership by contacting us via text message to our gym text line @ 817.374.4672 or emailing us at info@crossfitg6.com. Your 28 day notice will take affect upon first contact with us but we reserve the right to do an exit interview during that 28 day period. This is not meant to make it difficult to cancel - we just want to get feedback from you so G6 can improve our service. There are no refunds for membership fees and CFG6 will not prorate a cancelled membership.
6. Attire:
Appropriate footwear is required and there will be no working out barefoot for safety reasons.
7. Lost Articles:
CFG6 assumes no responsibility for lost or stolen articles. Lost and found articles not claimed will be donated to charity.
8. Smoking, Food and Drink:
No smoking is allowed in any part of the facility. Only drinks may be taken into workout area but it must be in an enclosed bottle or container.
9. Children:
Children are welcome at the gym, however they must stay in the dedicated kids area. The gym is not to be used as a playground. Please keep your kids off of the equipment and off the workout floor for their safety and the safety of others. By signing this agreement you are releasing G6 Fit LLC dba CrossFit G6 of any liability for any kids that you bring to the gym with you. G6 reserves the right to change this kids policy at anytime. If your kids can't behave and follow the rules while at G6 we reserve the right to ask that you not bring your kids in order to ensure the safety of all members and children.
10. Conduct:
CFG6 is committed to the health, safety, welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. CFG6 has the right to judge behavior and respond accordingly. This right includes, but is not limited to, termination of membership of any member engaging in unacceptable behavior.
11. Damages:
Members shall pay for any damages to CFG6 property which results from the willful or negligent conduct of member, member's guest or dependent children.
12. Rules and/or Regulations:
Members who do not observe CFG6 rules and regulations or who abuse equipment in any fashion will be asked to leave. The management reserves the right to terminate membership to anyone who refuses to observe any of CFG6's rules or regulations. Not all rules and regulations are listed in this agreement. CFG6 reserves the rights to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by CFG6
13. Use of Photo and Video:
CFG6, its representatives and employees have the right to take photographs of Member and Member's property while training with CFG6.
CFG6 is authorized to use and publish these photos or videos in print and/or electronically. CFG6 may use such photographs of Member with or without Member's name and for any lawful purpose. Some examples are Facebook, Instagram or any other publicity, illustration, advertising, or web content. We respect your privacy - If you do not wish to give us permission to use your photos then please notify us @ info@crossfitg6.com.
14. Miscellaneous:
a. This Agreement contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon prior written consent of all parties. This agreement shall be governed by the laws of the State of TX without regard to the principles of conflict of laws thereof and treated as a contract entirely made and execute within TX

Member has read, and fully agrees to the term of this Agreement and understands and agrees that by signing this Agreement (which contains a waiver, release and assumption of risks) Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement.
